Eduardo Moncado, a 42-year old carpenter of Stage General Services in Cebu City, was hit by a speeding motorcycle while on board his bicycle on his way home, at 5:15 pm of June 15, 2013. He was rushed to Mandaue Cortez General Hospital, and was later transferred to Vicente Sotto Medical Center, due to the fracture on his right arm.
During the course of his treatment, Moncado received no financial assistance from his employer. He also found out that his SSS contributions have not been remitted. These prompted Moncado to file a complaint against his employer.
While he was at the DOLE regional office in Cebu City to file a complaint, Moncado was referred to the Employees’ Compensation Commission for a possible availment of the benefits under the Employees’ Compensation Program.
To address Moncado’s immediate financial need, the ECC, through Information Officer Ms. Ingrid Yumang, communicated with his employer for a meeting to amicably reach a solution.
As a result of the meeting, the employer agreed to settle the wage difference obligation, payment of the SSS contributions, and assured Moncado of assistance in the processing of his EC medical reimbursement claims, subject to any penalty under the law that will be imposed by the SSS for the late compliance.
