EXPEDITING THE PROCESSING OF EC CLAIMS OF WORKERS FOR DISEASES ACQUIRED IN LINE OF DUTY DURING OUTBREAKS, EPIDEMICS AND PANDEMICS

WHEREAS, the primary purpose of P.D. No. 626, as amended, is to provide meaningful protection to workers and/or their families against the perils or hazards of disability or death due to work-related incidents;

WHEREAS, there are outbreaks, epidemics, and pandemics of diseases where workers become ill as a result of exposure while working inorder to continue providing much needed services to the public;

WHEREAS, there is a need for immediate provision of employees’ compensation benefits to these workers and/or their families to mitigate risks or prevent or minimize vulnerability;

WHEREAS, to hasten the grant of EC benefits to these workers and/or their families, this Commission finds the need to facilitate the processing of their benefit s under P.D. No. 626, as amended;

WHEREAS, Article 183 (177) paragraph (c)  of  P.D. No. 626,  as  amended empowers this Commission to approve rules and regulations governing the processing of EC claims;

NOW THEREFORE, ON MOTION DULY MADE AND SECONDED,

This Commission RESOLVES AS IT HEREBY RESOLVED, to direct the Systems to immediately process and release the corresponding EC benefits to the workers who acquired diseases in line of duty during outbreaks, epidemics and pandemics;

RESOLVED FURTHER, that the Systems shall be guided by the following in facilitating the processing of the EC benefits of the workers:

  1. The presentation of the following. together with the basic documents (logbook, application form) shall be sufficient for the processing and release of payment of loss of income benefits and the initial payment of death benefits;
    1. Medical diagnosis showing that the claimant was diagnosed as positive of the disease or having symptoms similar thereof thus classifying the worker as person under investigation (PUI) while on duty during the period of the outbreak or crisis;
    2. Certification from employer that the worker has been on duty during the period of outbreak or crisis;
  2. The Systems shall conduct field inspection, as necessary, to determine or validate the qualified beneficiaries;
  3. The Systems shall formulate the necessary guidelines to carry out the above­ mentioned directive and the facilitative processing of all EC benefits for the workers and/or their families:

RESOLVED FINALLY, that this Resolution shall take effect immediately and a copy of this Resolution be furnished to the Systems for guidance and compliance .
