APPROVING THE RETROACTIVE PAYMENT OF SUSPENDED EC DEATH BENEFITS IN THE PUBLIC SECTOR FROM APRIL 2006 TO JULY 2012
WHEREAS, on July 27, 2012, this Commission approved the issuance of Board Resolution (BR) No. 12-07-16 on “Policy on Lifting the Suspension of EC Death Benefits in the Public Sector Beyond the Five-Year Guaranteed Period’ with a prospective application effective August 2012 and with instruction to the GSIS to conduct another actuarial study on the possible payment of the suspended EC death benefits between April 2006, the year of suspension and July 2012;
WHEREAS, the GSIS has conducted an actuarial study on the possible retroactive payment of suspended EC death benefits for the specific period of April 2006 to July 2012 amounting to about Php2.52 billion covering about 31,683 survivorship pensioners as of May 14, 2013 as per data provided by the GSIS Operations Group;
WHEREAS the GSIS actuarial study shows the possibility of retroactive payment of accrued EC death benefits for the specific period of April 2006 to July 2012 without adversely affecting the viability of the State Insurance Fund (SIF) in the public sector and without need for an increase in EC contribution;
NOW THEREFORE, ON MOTION DULY MADE AND SECONDED;
This Commission hereby RESOLVES to approve the retroactive payment of suspended EC death benefits in the public sector to the following:
- Surviving legitimate spouses of the covered members provided that they did not remarry within April 2006 to July 2012; and/or
- Dependent children of the covered members within April 2006 to July 2012 provided that they possessed the following qualifications within the said period:
- Unmarried;
- Not gainfully employed; and
- Not over 21 years of age; or
- Over 21 years of age provided he/she is incapable of self-support due to a physical or mental defect which is congenital or acquired during minority;
RESOLVES FURTHER, that in the event that the abovementioned beneficiaries failed to meet the qualification anytime within April 2006 and July 2012, benefits shall be only granted for the period that the concerned beneficiaries were qualified to receive the same;
RESOLVES FINALLY, that this Resolution shall take effect immediately after its publication in a newspaper of general circulation and copy of this Resolution be transmitted to the GSIS for compliance.
