PRESCRIBING THE POLICY OF FACILITATING THE PROVISION OF EMPLOYEES’ COMPENSATION (EC) BENEFITS FOR THE AFP AND PNP WHO ARE WOUNDED OR KILLED IN MILITARY AND POLICE OPERATIONS

WHEREAS, a Memorandum of Agreement (MOA) was forged among the DND, the DILG, the Office of the President (OP), and other support agencies which include, among others, the DOLE to implement the Comprehensive Social Benefits Program (CSBP) for AFP and PNP battle/duty casualties and their dependents;

WHEREAS, the CSBP complies to Presidential directive to harmonize the various benefits and assistance to members of the AFP and PNP who are wounded or killed in military and police operations;

WHEREAS, the DOLE, in the said MOA, has committed to facilitate the grant of employees’ compensation benefits to the uniformed personnel who are wounded or killed in military and police operations;

WHEREAS, the issue of coverage of uniformed personnel under the Employees’ Compensation Program (ECP) has already been settled;

WHEREAS, the sacrifice and bravery of soldiers and policemen in putting their lives on the line should be acknowledged and appreciated;

WHEREAS, to honor their gallantry in the performance of their sworn duties, this Commission recognizes the need to effect a facilitative processing of the EC benefits for the uniformed personnel and/or their qualified beneficiaries who are wounded or killed in military and police operations;

WHEREAS, the AFP and the PNP provide social benefits to their personnel who are wounded or killed in military and police operations;

WHEREAS, this Commission implements rehabilitation programs which can supplement the social benefits provided by the AFP and PNP;

WHEREAS, Article 183 (formerly 177) par. (c) of PD. No. 626, as amended, empowers this Commission “to approve rules and regulations governing the processing of claims;”

NOW THEREFORE, ON MOTION DULY MADE AND SECONDED

This Commission RESOLVES as It hereby RESOLVED to provide the following assistance to the uniformed personnel, or to their qualified beneficiaries, who are wounded or killed in military and police operations:

  1. Facilitative processing of EC disability or death with funeral benefits for the AFP and the PNP battle/ duty casualties and their dependents. Upon receipt of the appropriate report on the incident/encounter with the list of uniformed personnel who are wounded or killed in military or police operations from the Commission or from the respective command and stations, the GSIS shall, within five days, facilitate the processing of EC disability benefits or death benefits of the concerned uniformed personnel and/or their qualified beneficiaries.
  2. Immediate Enrollment under the KAGABAY Program. Without need of waiting for the approval and/or release of EC disability benefits for the uniformed personnel who are wounded in action (WIA) from the GSIS, the Secretariat shall, within five days, upon receipt of the report of accidents/encounter from the AFP and/or the PNP, facilitate the possible enrollment of WIA under the KAGABAY program of the Commission to enable them to avail of supplementary rehabilitation services.

RESOLVED FURTHER, that all Rules or Regulations inconsistent with this Resolution are hereby repealed or modified accordingly;

RESOLVED FINALLY, that this Resolution shall take effect fifteen (15) days after its publication in a newspaper of general circulation and copy of this Resolution be furnished to the GSIS for information and guidance.
